39 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A PERMIT <br />TO CHESAPEAKE AND POTOMAC TELEPHONE COMPANY OF VIRGINIA FOR <br />THE USE OF A PORTION OF THE RIGHT-OF-WAY OF RIVER POINTE <br />PARKWAY FOR CONSTRUCTION, INSTALLATION, OPERATION AND <br />MAINTENANCE OF FIBER OPTIC LINES AND A SWITCHING STATION. <br /> <br /> WHEREAS, Chesapeake and Potomac Telephone Company is <br />currently upgrading its facilities in the City of Portsmouth, <br />Virginia; and <br /> <br /> WHEREAS, the City is installing fiber optic lines <br />throughout the city which necessitate switching equipment; and <br /> <br /> WHEREAS, River Pointe Parkway offers the best location <br />for the necessary switching equipment in the area now being <br />upgraded; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, <br />deems it to be in the best interest of the City to permit <br />Chesapeake and Potomac Telephone Company of Virginia to use a <br />portion of the right-of-way of River Pointe Parkway for this <br />purpose. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to execute a permit to Chesapeake and <br />Potomac Telephone Company of Virginia on property of the City <br />of Portsmouth, Virginia, more particularly described by that <br />certain exhibit entitled "Exhibin 'A' showing C&P Telephone <br />Company Fiber Optic Hut Right-Of-Way Encroachment Area Site of <br />Existing Pump Station ~57 Located at River Pointe Parkway, <br />Portsmouth, Virginia (Reference: p.B. 962, P. 578)" dated <br />February 17, 1992, prepared ~y Hdrton & Dodd, P.C. Surveyors, <br />Engineers & Planners, Chesapeake, Virginia, attached hereto <br />and made a part hereof, subject to such conditions as the City <br />Manager shall deem to be in the best interest of the City. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on April 14, 1992. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
