The applicant shall seek to <br />have rezoned or agree to allow the City of <br />Portsmouth to rezone the designated recreational <br />site as Preservation (P-l). The rezoning shall be <br />complete prior to issuance of more than 50% of the <br />certificates of occupancy. <br /> <br />The applicant shall submit plans for a pedestrian <br />walking trail and bike path system for the entire <br />River Pointe residential development. The portions <br />of the system contained within the property subject <br />to this group housing use permit shall be completed <br />prior to issuance of more than 50% of the <br />certificates of occupancy. <br /> <br />(k) <br /> <br />Any revisions to the originally-submitted site plan, <br />landscaping plan, or elevations approved during the <br />group housing use permit application process, <br />including any changes adopted by City Council, must <br />be incorporated into a revised site plan, <br />landscaping plan, or elevations, as applicable, and <br />must be submitted to the Planning Department for <br />approval prior to the issuance of any building <br />permits. <br /> <br />(1) <br /> <br />The applicant shall comply with all applicable <br />codes, ordinances, and regulations of federal, state <br />and local governments and shall obtain all necessary <br />licenses and permits. <br /> <br />(m) <br /> <br />This permit is non-transferable and shall expire at <br />such time as the applicant shall cease to exist as a <br />limited liability corporation. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held August 24, 1993. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
