(h) <br /> <br />Street lighting with high pressure sodium fixtures <br />shall be provided along all private streets in <br />accordance with recommended Illumination Engineering <br />Standards (I.E.S.) contained in American National <br />Standard Practice for Roadway Lightiq~ A lighting <br />plan for the development must be approved by the <br />City's Department of Traffic EngineerinG prior to <br />issuance of building permits. <br /> <br />(±) <br /> <br />A condominium association shall <br />be responsible for maintaining <br />private roadways and recreation <br /> <br />be created and shall <br />the retention lake~ <br />area. <br /> <br />{j) <br /> <br />Any revisions to the originally submitted site plan, <br />landscaping plan, or elevations approved during the <br />group housinG use permit application process, <br />including any changes adopted by City Council, must <br />be incorporated into a revised site plan, <br />landscaping plan, or elevations, as applicable, and <br />must be submitted to the Planning Department for <br />approval prior to the issuance of any building <br />permits. <br /> <br />(k) <br /> <br />The applicant shall submit plans for a pedestrian <br />walking trail and bike path system for the entire <br />River Pointe development. Those portions of the <br />system contained within the area subject to the <br />group housing permit shall be completed prior to <br />issuance of fifty percent (50%) of the certificates <br />of occupancy. <br /> <br />(1) <br /> <br />The applicant shall provide a five (5) acre park <br />with a club house aad a swim~,!nG pool as amenities. <br />The developer shall seek to have rezoned or agree to <br />allow the City of Portsmouth to rezone as <br />Preservation P-1 the area designated as a park. <br /> <br />(m) <br /> <br />The applicant shall comply with all applicable <br />codes, ordinances, and regulations of federal, state <br />and local Governments and shall obtain all necessary <br />licenses and permits. <br /> <br />(n) <br /> <br />This permit is non-transferable and shall expire at <br />such time as the applicant shall cease to exist as a <br />limited liability corporation. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held August 24, 1993. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
