(h) <br /> <br />The project provides parking, building <br />access and pathways for persons with <br />disabilities in accordance with the <br />requirements of the Americans with <br />Disabilities Act. <br /> <br /> 2. That a group housing use permit for the construction <br />of ninety-six (96) duplex-style condominium or fee simple <br />units on a portion of Tax Map 709, Parcel 1 is hereby granted <br />to River Pointe Associates, L.L.C., subject to the following <br />terms and conditions: <br /> <br />(a) The group housing project shall be limited to <br /> ninety-six (96) condominium or fee simple units <br /> forty-eight (48) buildings. <br /> <br />in <br /> <br />(b) <br /> <br />The exterior of the condominium units shall be <br />constructed of the same materials and architectural <br />designs and details used in the "Kings Ford" <br />condominium project in Chesapeake, Virginia. <br />Additional models and architectural changes may be <br />approved by the Planning Commission prior to the <br />issuance of a building permit. <br /> <br />The site layout and landscaping shall be in <br />accordance with Exhibits A and B, attached hereto <br />and made a part hereof. Minor modifications may be <br />made by the Planning Director prior to issuance of <br />building permits. <br /> <br />(d) <br /> <br />A Landscaping Group 2 buffer shall be planted along <br />River Pointe Parkway and River Pointe Drive prior to <br />completion of 25% of the construction, <br /> <br />(e) <br /> <br />The site plan must conform to all requirements of <br />the Chesapeake Bay Preservation Area Overlay <br />Ordinance and the Tree Replacement Ordinance of the <br />Code of the City of Portsmouth. <br /> <br />(f) <br /> <br />The applicant shall preserve and protect existing <br />trees in the Resource Protection Area of the <br />Chesapeake Bay Preservation Area. Only the building <br />footprint area, driveway area and walkway area in <br />the landward fifty (50) feet of the Resource <br />Protection Area may be disturbed. <br /> <br />(g) <br /> <br />The proposed private street in the condominium <br />development shall be thirty (30) feet wide. An <br />agreement, to the satisfaction of the City Attorney, <br />must be executed providing for the maintenance of <br />the private street by the condominium owners <br />association and for the annual collection and <br />placing in reserve of sufficient funds for such <br />purpose. <br /> <br /> <br />
