Section 40-44.1. Dimensional Requirements. <br /> <br />(c) <br /> <br />ALL DISTRICTS -- CORNER VISIBILITY. In addition to <br />the dimensional requirements set forth in the <br />Dimensional Requirements tables included in this <br />Article, on every corner lot, within the triangle <br />formed by the property lines of such lot and a line <br />drawn between points on such lines at the distances <br />from the fntersection thereof that are specified <br />below, there shall be no fence (other than an open <br />wire fence) or wall higher than three (3) feet nor <br />any obstruction to vision between a height of three <br />(3) feet and a height of ten (10) feet above the <br />established grade of each street, or, if no grade <br />has been officially established, then above the <br />average elevation of the existing surface of each <br />street at the center line thereof, as follows: <br /> <br />(iii) <br /> <br /> 4. That Section 40-116 <br />Portsmouth, Virginia, 1988t be amended by adding <br />subsection (h) to read as follows: <br /> <br />For lots in any historic or downtown zoning <br />district, these standards may be waived or <br />modified by the appropriate commission of <br />architectural review or the downtown design <br />committee, after approval by the city traffic <br />engineer, to the extent necessary to fulfill <br />the purposes and objectives declared in <br />Section 40-51. <br /> <br /> of the Code of the City of <br /> thereto a new <br /> <br />Section 40-116. Standards for group housing use permits. <br /> <br /> The City Council may approve a group housing use permit <br />application only if it finds the following: <br /> <br />(h) <br /> <br />The project provides parking, building access and <br />pathways for persons with disabilities in accordance <br />with the requirements of the Americans with <br />Disabilities Act. <br /> <br /> 5. That Section 40-172 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding a new <br />subsection (c) thereto to read as follows: <br /> <br />40-172. Site development plan review required. <br /> <br />(c) <br /> <br />Approved final Site development plans shall remain <br />valid for a period of five (5) years, from the date <br />of approval by the city engineer. <br /> <br /> <br />
