AN ORDINANCE TO AMEND CHAPTER 37 OF THE CODE OF THE CITY OF
<br />PORTSMOUTH, VIRGINIA, I988, BY AMENDING SECTIONS 37-21, 37-22,
<br />37-24, 37-25, 37-26, 37-28, 37-29, 37-32, 37-35, 37-36, 37-37,
<br />37-38, 37-61, 37-67, 37-68(a). 37-91(a) AND (b), 37-92, 37-93~
<br />37-94, 37-95, 37-97, 37-98, 37-99, 37-100, 37-101(a), 37-182,
<br />37-103, 37-104, AND 37-105 THEREOF, PERTAINING TO TAXICABS AND
<br />OTHER VEHICLES FOR HIRE.

<br /> BE IT CRDAINED by the Council of the City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That Article II of Chapter 37 of the Code of the
<br />City of Portsmouth, Virginia, 1988, be redesignated "Taxicabs
<br />and Other Public Vehicles."
<br />
<br /> 2. That Section 37-21 of the Code of the City of
<br />Portsmouth, Virginia, 1988, be amended and reordained by
<br />adding thereto the definition of "Public vehicle" to read as
<br />fcllows:

<br />Section 37-21. Definitions.
<br />
<br /> The following words, terms and phrases, when used in
<br />article shall have the meanings ascribed to them in this
<br />section, except where the context clearly indicates a
<br />different meaning:

<br /> Public vehicle. The words "public vehicle" shall mean
<br />any public motor-driven vehicle, including a taxicab,
<br />regulated by this chapter and used for the transportation of
<br />passengers for compensation. For the purposes of this
<br />chapter, an employee hauler, as defined in Section 37-216, is
<br />not a public vehicle.

<br /> 3. That Sections 37-22, 37-24, 37-25, 37-26, 37-28,
<br />37-29, 37-32, 37-35, 37-36, 37-37, 37-38, 37-61, 37-67,
<br />37-68(a), 37-91(a) and (b), 37-92, 37-93, 37-94, 37-95, 37-97,
<br />37-98, 37-99, 37-100, 37-101(a), 37-102, 37-103, 37-104, and
<br />37-105 of the Code of the City of Portsmouth, Virginia, 1988,
<br />be amended and reordained to read as follows:

<br />Section 37-22. Compliance with article.
<br />
<br /> The operation of public vehicles upon the streets of the
<br />City shall be subject to the conditions, regulations and
<br />restrictions set forth in this article. It shall be unlawful
<br />to operate or cause to be operated within the City any public
<br />vehicle unless such conditions, regulations and restrictions
<br />are complied with by owners, operators and drivers. Nothing
<br />contained herein shall prohibit a public vehicle duly licensed
<br />in another city or county from delivering a passenger picked
<br />
