1993-10 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 40-22, <br />40-43.6, 40-44.t(c), 40-52.1 (a) AND (b), 40-52.3, 40-57.4, <br />40-61.2, 40-71.1(c), 40-71.2(a) AND (d), 40-73, 40-116, AND <br />40-172 AND TABLE 40-61.1-1 THEREOF, PERTAINING TO ZONING <br />REGULATIONS AFFECTING STREETS, HISTORIC DISTRICTS, <br />LANDSCAPING, GROUP HOUSING USE PERMITS, SITE DEVELOPMENT <br />PLANS, AND SIGNS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 40-43.6, 40-52.1(a) and (b), 40-52.3, <br /> 40-57.4, 40-71.1(c), 40-71.2(a) and (d), and 40-73 of the Code <br /> of the City of Portsmouth, Virginia, 1988, be amended to read <br /> as follows: <br /> <br />Section 40-43.6. Street access requirements. <br /> <br /> No structure shall be erected on any lot that does not <br />abut a public street as defined in Section 40-22. No building <br />or other permit shall be issued for a proposed commercial or <br />industrial use otherwise permitted by this chapter unless such <br />building or use will be located on a zone lot which abuts a <br />street that is fully improved to standards set by the <br />subdivision ordinance as in effect on the date of the permit <br />application. For the purDoses of determining compliance with <br />this section, a zone lot will be considered to abut a street <br />fully improved to the standards of the subdivision ordinance <br />if that portion of the street abutting the lot and extending <br />to the centerline of the street right-of-way complies with the <br />standards of the subdivision ordinance. <br /> <br />Section 40-52.1. Historic district; uses. <br /> <br /> Permitted uses in <br />according to three (3) <br />maD: <br /> <br />(a) <br /> <br />the historic district shall be governed <br />sub-districts, as shown on the zoning <br /> <br />HISTORIC RESIDENTIAL. Permitted uses shall be <br />limited to detached single family dwellings, family <br />care residences for adults or children, and <br />accessory uses as defined in Section 40-22. In the <br />Olde Towne Historic District, bed and breakfast inns <br />as provided for in Section 40-52.7 shall be <br />permitted only upon issuance of a use permit. <br />Churches, schools, day-care centers, and two-family <br />dwellings, multi-family dwellings, and attached row <br />dwellings shall be permitted only upon issuance of a <br />use permit. A single dwelling unit in a building <br />used as a church or school shall be permitted only <br />upon issuance of a use permit that specifies that <br />purpose. <br /> <br /> <br />
