which he/she would, without written permission, be in <br />violation of this ordinance. The written permission shall <br />include all of the above information, and the minor shall <br />carry it on his/her person. <br /> <br /> (e) Any minor, detained for a first violation of this <br />ordinance, shall be processed as follows: <br /> <br />i) <br /> <br />Where the minor is cooperative and provides a <br />home address within the City of Portsmouth, <br />the officer may transport the minor to his/her <br />home and release said minor to a responsible <br />adult. A verbal warning shall be given to the <br />parent, along with a copy of the Curfew <br />For Minors Ordinance. In the event the minor <br />is released to the parent, it shall be <br />evidenced by the parent's signature on a <br />Portsmouth Police Department Youth Card. <br /> <br />ii) <br /> <br />Where the minor resides outside the city <br />limits~ or no responsible adult can be <br />contacted, the officer shall transport the <br />minor to the Portsmouth Police Department. <br />The officer will contact the on-call Intake <br />Worker to facilitate placement of the minor <br />for protective custody if the parent cannot be <br />reached within a reasonable time. <br /> <br />iii) <br /> <br />A record of this event containing a brief <br />description of the circumstances shall be kept <br />on file by the Portsmouth Police Department. <br /> <br /> (f) Any minor~ detained for a second or subsequent <br />violation of this ordinance within a twelve month period, <br />shall be subject to any order of disposition authorized by <br />Section 16.1-278.4 of the Code of Virginia, 1950, as amended <br />entitled "Children in need of services." <br /> <br /> (g) Parental responsibility. It shall be unlawful for <br />any parent to permit a minor to act in violation of the <br />provisions of this ordinance. It shall not be a defense that <br />a parent was completely indifferent to the activities or <br />conduct or whereabouts of such minor. Upon the initial <br />detention of any minor, notice of such violations along with a <br />copy of the Curfew For Minors Ordinance shall be given to the <br />parents~ either in person, or by certified mail. Upon a <br />second or subsequent detention of any minor, the parent or <br />parents shall be charged with a violation of this section, and <br />subject to such conditions and limitations as the Court may <br />order with respect to such child and the parents. ~nere the <br />Court finds a hearing that a parent has willfully contributed <br />to, encouraged, or caused a violation of this ordinance, that <br />parent or parents shall be guilty of a Class 1 Misdemeanor. <br /> <br /> <br />
