AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988, BY AMENDING SECTION 24-8 THEREOF, PERTAINING <br />TO CURFEW FOR MINORS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section <br />Portsmouth, Virginia, <br />as follows: <br /> <br /> 24-8 of the Code of the City of <br />1988~ be amended and reordained to read <br /> <br />Section 24-8. <br /> <br />Curfew for minors. <br /> <br /> (a) Definitions. For the <br />the following terms and phrases <br />here. <br /> <br />purpose of this ordinance <br />shall have the meaning given <br /> <br />(±) <br /> <br />Minor. Any person under the age of seventeen <br />(17) years. <br /> <br />(ii) <br /> <br />Parent. Any person having legal custody of a <br />minor either as a natural or adoptive parent, <br />or as a legal guardian, or as a person who <br />stands in loco parentis~ or as a person to <br />whom legal custody has been given by order of <br />court. <br /> <br />(iii) Adult. Any person at least eighteen (18) <br /> years of age. <br /> <br />(iv) Remain. To stay behind, to tarry and to stay <br /> unnecessarily in a place, to hang out/around. <br /> <br />(v) <br /> <br />Lawful activity. Any activity which is now <br />otherwise illegal, where a minor acts under <br />the supervision of an adult~ with the <br />knowledge and permission of his parents or <br />guardian. <br /> <br />(vi) <br /> <br />To permit. As used in section (g) this phrase <br />shall refer to that knowledge which a parent <br />should reasonably be expected to have <br />concerning the whereabouts of a minor in <br />his/her custody. This phrase is intended to <br />provide an objective standard for parental <br />responsibility, so as to require neglectful or <br />careless parents to adhere to a reasonable <br />community standard. <br /> <br /> (b) Curfew for minors. It shall be ~ violation of this <br />section for any minor under the age of seventeen (17) to be <br />and remain in or upon any public place, including, but not <br />limited to, any street, sidewalk, alley, playground, park or <br />place of amusement in the City of Portsmouth between the hours <br /> <br /> <br />
