AN ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 2-425 AND <br />2-426 THEREOF PERTAINING TO THE DEPARTMENT OF PUBLIC HEALTH. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 2-425 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended and reordained to read <br />as follows: <br /> <br />Section 2-425. <br /> <br />Right of Entry of Director and Department <br />Officers and Employees. <br /> <br /> (a) The Director of Public Health and all Officers and <br />Employees of the Health Department of the City and their <br />agents shall have the power, and it shall be their duty to <br />enter all lots, outhouses, dwellings, stables, wharves, <br />warehouses and other premises for the purpose of examining <br />such premises as to their general sanitary condition; <br /> <br /> (b) Whenever it is found by the Department of Public <br />Health that a child less than six (6) years of age, or a <br />pregnant woman, residing within the City has been found to <br />have an elevated blood lead level as defined by the Centers <br />for Disease Control of the U. S. Department of Health and <br />Human Services, then the Director of Public Health and all <br />Officers and Employees of the Health Department of the City <br />and their agents shall have the power, and it shall be their <br />duty to enter all premises, dwellings, dwelling units, rooming <br />houses, rooming units or any facility occupied, used or likely <br />to be used by a child less than six (6) years of age, or a <br />pregnant woman, for the purpose of conducting a health <br />inspection to determine the presence of a lead hazard. <br /> <br /> 2. That Section 2-426 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended and reordained to <br />as follows: <br /> <br />read <br /> <br />Section 2-426. <br /> <br />Authority to Order Abatement of Nuisances; <br />noncompliance. <br /> <br /> (a) If, upon entering any 9remises pursuant to Section <br />2-425, the Director of Public Health or other Officer or <br />Employee of the Health Department shall find any condition <br />that is detrimental to the health of the inhabitants or people <br />living or employed in such premises, the Director shall order <br />the occupant, owner or his agent, or the person who, under the <br />terms of the lease or rental, is responsible for the upkeep of <br />the same to abate the nuisance within a reasonable time. <br /> <br /> <br />
