AN ORDINANCE CLOSING A PORTION OF PENNOCK STREET. <br /> <br /> WHEREAS, the City of Portsmouth, Virginia, desires to <br />vacate, close and discontinue the hereinafter described portion <br />of Pennock Street; and <br /> <br /> WHEREAS, by a Resolution of this Council adopted on <br />January 25, 1994, viewers were appointed pursuant to Section <br />15.1-364, of the Code of Virginia, 1950, as amended, to view <br />the hereinafter described portion of said street and to report <br />in writing whether in their opinion any, and if any, what <br />inconvenience would resuIt from discontinuing said portion of <br />Pennock Street; and <br /> <br /> WHEREAS, the said viewers have reported in writing that in <br />their opinion, no inconvenience would result from the closing <br />and discontinuing of that portion of Pennock Street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the portion of said street <br />hereinafter described be closed and vacated as a public street. <br /> <br /> A portion of unimproved Pennock Street, as <br />shown on Plate 151 of the records of the City <br />Assessor for the City of Portsmouth, bounded on <br />the west by the eastern side of Deep Creek <br />Boulevard and property of Wesley Frye, and <br />bounded on the east by that portion of Pennock <br />Street previously closed and vacated by <br />Ordinance number 1991-59 of the Council of the <br />City of Portsmouth; said portion of Pennock <br />Street to be closed and vacated extending <br />eastwardly from Deep Creek Boulevard three <br />hundred and eighty feet. <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth, <br />Virginia, hereby reserves unto itself a perpetual easement, <br />rights and privileges to install, operate, maintain and replace <br />sewer mains, sewer drains, sanitary sewers, water mains and <br />storm drains over, under and across the hereinabove described <br />portion of Pennock Street. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on May 10, 1994. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
