ALL that lane or alley lying in the block <br />bounded by Wavy (formerly Harrison) Street <br />Randolph Street and Ruth Brown Avenue <br />(formerly Second Street), and First Street <br />and being parallel to First Street. <br /> <br />ALL that certain piece or parcel of land, <br />situate, lying and being in the City of <br />Portsmouth, Virginia, sometimes described <br />as a lane, which lane is a strip of land <br />approximateIy 12.586 feet in width located <br />in the center of the block bounded on the <br />north by Wavy (formerly Harrison) Street, <br />on the east by Ruth Brown Avenue (formerly <br />Second Street), on the south by Randolph <br />Street and on the west by Third Street, <br />said parcel or strip of land being parallel <br />to Ruth Brown Avenue and Third Street, and <br />running from the southern right-of-way line <br />of Warty Street, south to the northern <br />right-of-way line of Randolph Street. <br /> <br /> ALL that portion of Wavy (formerly <br />Harrison) Street bounded on the east by the <br />western right-of-way line of First Street <br />and on the west by the eastern right-of-way <br />line of Ruth Brown Avenue (formerly Second <br />Street). <br /> <br /> BE IT FURTHER ORDAINED by the City of Portsmouth hereby <br />reserves unto itself a temporary easement, right and privilege <br />to operate, maintain and replace water mains, over, under and <br />across the hereinabove described portions of streets, lanes <br />and/or alley, for the purpose of removing the aforesaid as it <br />may have within said right-of-way(s), including but not limited <br />to those set forth herein, and to include all pavement and <br />curbs. <br /> <br /> BE IT FURTHER ORDAINED that this vacation and closure is <br />conditioned upon the commencement of development of a proposed <br />business on land adjoining said streets, lanes or alley within <br />a period of sixty (60) days of the adoption of this Ordinance. <br />Failure to commence said development within such period, may <br />render the vacation and closure of the portions of the streets, <br />lanes and/or alley as described herein, null and void at the <br />option of the Portsmouth City Council. <br /> <br /> <br />
