24 A RESOLUTION REQUESTING T~E VIRGINIA DEPARTMENT OF TRANSPORTATION TO PROCEED WIT~ ALLOCATION OF FUNDiNG AND IMPLEMENTATION OF PAINTING A/qD NECESSARYREPAIRS TO T~E STEEL STRUCTURE OF T~E C~URC~LAND BRIDGE LOCATED ON ROUTE 17, PORTSMOUTI{, VIRGINIA, AS AN URBAN ROAD PROJECT. WHEREAS, the Commonwealth of Virginia, Department of Transportation has approved a highway allocation in the Final Allocation of Funds Fiscal Year 1994-95 dated July 1, 1994 in which certain road projects were designated for funding, design, and construction within the next six years; and WHEREAS, the Virginia Department of Transportation agreed, as provided by law and Board policy, to allocate available urban highway funds for said project; and W~EREAS, this Council deems it to be in the best interests of the City to proceed immediately with the Churchland Bridge Project, NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the Virginia Department of Transportation be, and it hereby is, requested to proceed with allocation of funding, design and construction for painting and repairs to the Churchland Bridge. BE IT FURTHER RESOLVED that the Council of the City of Portsmouth, Virginia, hereby agrees to pay its share of the total cost for preliminary engineering, right-of-way and construction of this project in accordance with Section 33.1-44, Code of Virginia, and that if the City subsequently decides to cancel such construction after the Department has initiated the project, the City agrees to reimburse the Department the total amount of costs expended by the Department through the date the Department is notified of such cancellation, and provided further that the Transportation Commissfon shall have authority to waive all or any portion of such reimbursement at its discretion.
