AN ORDINANCE TO AMEND AND REORDAIN iN ITS ENTIRETY CHAPTER 34 <br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, PERTAINING TO <br />SWIM/~ING POOLS TO INCORPORATE AND COMPLY WITH THE PROVISIONS OF <br />THE VIRGINIA UNIFORM STATEWIDE BUILDING CODE AND THE VIRGINIA <br />BOARD OF HEALTH SWIMMING POOL REGULATIONS. <br /> <br /> BE IT ORDAINED by the City Council of the City of <br />Portsmouth, Virginia: <br /> <br /> That Chapter 34 of the Code of the City of Portsmouth, <br />Virginia, is hereby amended and reordained uo read as follows: <br /> <br />ARTICLE 1. IN GENERAL <br /> <br />Sec. 34-1. Title. <br /> <br /> This chapmer shall be known and cited as the "Portsmouth <br />Swimming Pool Ordinance." <br /> <br />Sec. 34-2. Scope. <br /> <br /> (a) The Virginia Board of Health Swimming Pool <br />Regulatmons and the Virginia Uniform Statewide Building Code, <br />as amended, including all future amendments thereto and <br />editions thereof, and all model building codes and portions of <br />other model codes or standards which are, or may hereinafter <br />be, referenced, adop5ed or incorporated therein, are hereby <br />adopted and incorporated by reference into this chapter o~ the <br />Code of mhe City of Portsmouth. <br /> <br /> (b) The provisions of this chapter shall apply to all <br />public swimming pools as indicated and defined in section 34-3, <br />including but not limited to commercial pools, public or <br />private school pools, gymnasium pools and health establishment <br />pools. Public swimming pools for which building permits are <br />issued subsequent to the effective date of this chapter shall <br />be constructed in accordance with provisions of the ~irginia <br />Uniform Statewide Building Code, fire prevention code, the <br />zoning ordinance and this chapter. The administrative <br />authority or authorized agent shall order reasonable changes in <br />any public pool or related facility or in its operation if <br />finds any condition(s) that endanger the life, health or safety <br />of the users of such public swimming pools. In considering <br />whether to order such changes, the administrative authority <br />shall consider the magnitude of the danger, cost of the <br />change(s) required, and the requirements imposed by this <br />chapter upon newly constructed public swimming pools. <br /> <br />(c) Private swimming pools shall be constructed in <br /> <br /> <br />
