and egress. <br /> <br />(g) Design and Color Scheme: A facility'S design and <br />colors shall be consistent with guidelines established by <br />the Planning Commission. <br /> <br />(h) Historic and Downtown Design Districts: A facility <br />to be located in a historic or a downtown design district <br />shall also be reviewed and approved by the appropriate <br />architectural review commission or downtown design <br />committee. <br /> <br />(~) Exemption: Any facility which is less than two feet <br />in height and covers an area of not more than two square <br />feet shall be exempt from all of the above criteria, <br />except those contained in (h) above. <br /> <br />The Director of Planning shall refer to the Planning Commission <br />for review and approval any proposed facility which, in his <br />opinion, is inconsistent with the above criteria. <br /> <br /> 2. That Section 40-172.1 (c) of the Code of the City of <br />Portsmouth, Virginia (1988) be amended by adding thereto a new <br />subsection (9) to read as follows: <br /> <br />Sec. 40-172.1. Site development plan submission requirements. <br /> <br /> Site development plans shall be prepared and stamped by <br />a professional engineer or land surveyor licensed in the <br />Commonwealth of Virginia. Such plans shall contain elevations <br />based upon City of Portsmouth data as furnished by the City <br />Engineer. Unless the City Engineer shall determine that some <br />deviation necessary to prevent a demonstrable hardship upon the <br />property owner is in the best interest of the public safety, <br />the site plan shall contain the following minimum requirements: <br /> <br />(c) Improvements: <br /> <br />(9) Ail propoSed private utility lines and easements <br />including the locations and details of the <br />aboveground utility facilities. <br /> <br /> 3. That Tables 40-43.1-1, 40-43.1-2 and 40-43.1-3 of the <br />Code of the City of Portsmouth, Virginia (1988) be amended by <br />amending the Use "Telephone Exchange and Fiber Optics Building" <br />to read "Telephone and Exchange Fiber Optics Facility," as <br />shown on Exhibits A, B and D, attached hereto and made a part <br /> <br /> <br />
