AN O~DINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-43.4 (60) <br />AND 40-172.1 (C) AND TABLES 40-43.1-1, 40-43.1-2 AND 40-43.1-3 <br />THEREOF, PERTAINING TO ABOVEGROUND UTILITY STRUCTURES. <br /> <br /> BE IT ORDAINED by nhe Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-43.4 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to read <br />as follows: <br /> <br />Sec. 40-43.4. Conditions for specific uses. <br /> <br /> (60) Limited to facilities involved in the distribution <br />of telephone, electric power, natural gas and cable television <br />utilities. Aboveground s5rucnures and cabinets shall be built <br />and located according uo a design approved by the Director <br />of Planning after review of a site plan, landscaping plan, and <br />elevations. <br /> <br />Plans approved shall be consistent with nhe following <br />criteria: <br /> <br />(a) Height: The facility shall non exceed fifteen feet in <br />height. <br /> <br />(b) Area: The facility shall not cover an area in excess <br />of 750 square feet. <br /> <br />(c) Setbacks and Location: The facility shall non be <br />located in any required front yard and shall be located <br />au least five feet from any property line and ten feet <br />from any principal snrucmure. Buildings shall be placed <br />in a rear yard away from a public street. <br /> <br /> (d) Landscaping: Sufficient landscaping shall be <br />provided to screen the facility from all public sEreens <br />and to make the facility compatible with the neighborhood. <br /> <br />(e) Maintenance: The owner of the facility shall execute <br />a maintenance agreement in a form approved by the City <br />Atnorney and which shall obligate the owner and its <br />successors in interest to maintain the landscaping <br />installed in accordance with (d) above. <br /> <br />(f) Access: Each facility shall provide for safe ingress <br /> <br /> <br />
