Chesapeake. For any amount of water supplied during a billing period in excess of 3.0 mgd,

Chesapeake agrees to pay Rate B, which equals 120% of Portsmouth's then-current retail rate

to its residential customers residing in Portsmouth. For example, if, during a billing period,

Chesapeake's billing period average daily rate of flow is 4.5 mgd, then 3.0 mgd shall be

billed at Rate A and 1.5 mgd shall be billed at Rate B. Rate increases charged to Chesapeake

for any water purchased shall take effect on the effective date of any increase by Chesapeake

of its retail rate to its citizens or any increase by Portsmouth of its retail rate to its citizens,

whichever is applicable.

7. WATER RESTRICTION EFFECT ON RATES. In the event that

Portsmouth imposes water restrictions on any day(s) during a billing period, the monthly bill

during such billing period, which shall be referred to herein as the "water restriction

adjustment bill", shall be calculated in tlie following manner.

A. The "water restriction rates" are the rates charged to Chesapeake for the water

restriction adjustment bill period. The water restriction rates shall be determined by

multiplying the non-water restriction rates by certain ratios to be determined as follows.

B. An "annual average daily rate of flow" shall be u 'tdized to determine the ratios

referred to in Paragraph A of this section. The annual average daily rate of flow shall be

determined by averaging the average daily rate of flow, as determined from all of the

Portsmouth master metered delivery points, for the immediately preceding twelve billing

periods during which there were no water restrictions.

C. Ratio A = 1.0 minus Ratio B.

D. Ratio B = (annual average daily rate of flow minus 3 mgd) divided by the

4
