{g) Prior to application for a building permit, <br /> written statements from the Federal Aviation <br /> Administration (FAA), and the Federal <br /> Communication Commission (FCC), stating that the <br /> proposed tower is consistent with or exempt from <br /> their regulations, must be given to the Director <br /> of Planning. <br /> <br /> (h) The facility must be landscaped, in accordance <br /> with Exhibit A as submitted by the applicant, <br /> with the addition of pine trees to buffer-the <br /> facility from the residents in Chesapeake and the <br /> view from Tyre Neck Road. Shrubs must be at least <br /> 36 inches in height and trees must be at least 1 <br /> and 1/2 inch in caliper. All landscaping must be <br /> maintained in good condition. <br /> <br /> (i) Prior to application for a building permit, the <br /> applicant must provide the Director of Planning <br /> with a statement from a registered structural or <br /> civil engineer that the non-electromagnetic <br /> radiation (NIER) emitted from the proposed <br /> facility will not result in ground level exposure <br /> exceeding standards established by any U.S. <br /> Government agency or the American Standards <br /> Institute. <br /> <br /> (j) The applicant must construct and maintain a storm <br /> water management practice that will meet the <br /> requirements of the Chesapeake Bay Area Overlay <br /> Ordinance. <br /> <br /> (k) The applicants shall comply with all applicable <br /> codes, ordinances and regulations of federal, <br /> state and local governments, and shall obtain and <br /> maintain in effect all necessary licenses and <br /> permits. <br /> <br /> 4.
