AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING TABLES 40-44-1 AND <br />40-44-2 AND SECTION 40-22 THEREOF, PERTAINING TO MINIMUM UNIT <br />LIVING AREAS AND RESIDENTIAL RS-85 ZONING DISTRICT YARD <br />REQUIREMENTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Table 40-44-1 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to <br />exclude the floor areas of garages and patios from the <br />calculation of the minimum floor area in each unit as shown on <br />Exhibit A, attached hereto and made a part hereof. <br /> <br /> 2. That Table 4C-44-2 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to add <br />certain yard requirements in the Residential RS-85 zoning <br />district as shown on Exhibit B, attached hereto and made a part <br />hereof. <br /> <br /> 3. That Section 40-22 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to add <br />thereto the definition of "Floor Area in Unit" to read as <br />follows: <br /> <br />Floor Area in Unit. Living area exclusive of garage and patio. <br /> <br /> 4. That this ordinance shall take effect on the date of <br />its adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on March 28, 1995. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
