AN ORDINANCE AMENDING SECTION 22-565(b) AND SECTION 22-583[a) <br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988}, AS <br />AMENDED, PERTAINING TO PROCEDURES AND PENALTIES FOR PARKING <br />VIOLATIONS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 22-565(b) of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained to read <br />as follows: <br /> <br />Sec. 22-565. <br /> <br />Parking, <br />driveway, <br />station, <br /> <br />standing in front of private <br />near fire hydrant or fire <br />etc. <br /> <br /> (b) A violatzon of this section shall be punishable by a <br />fine of twenty-five dollars ($25.00). <br /> <br /> 2. That Section 22-583 (a) of the Code of the City of <br />Portsmouth, Virginia, (1988), be amended and reordained to read <br />as follows: <br /> <br />Sec. 22-583. Procedure and penalties for parking <br /> violations. <br /> <br /> (a) Except where otherwise provided, it shall be the duty <br />of each police officer of the City, or other uniformed <br />employees of the police department whose normal duties include <br />parking enforcement, to give to the person operating a motor <br />vehicle illegally parked, a notice, or to attach to the vehicle <br />found so parked, a notice to the owner that the vehicle has <br />been illegally parked and instructing him/her to report to the <br />City Treasurer or the Police Records Office of the Portsmouth <br />Police Department to pay the penalty of ten dollars ($10.00) or <br />state objection to and intent to contest the notice of <br />violation. If the owner of the vehicle fails to make said <br />payment within fourteen (14) days of the time the notice was <br />attached to the vehicle, or state objection to and intent to <br />contest the notice of violation, he/she shall again be notified <br />and an additional penalty of ten dollars ($10.00) shall be <br />charged for the additional notice. All monies due shall be <br />paid to the City Treasurer or the Police Records Office of the <br />police department who shall be accountable therefor. Failure <br />of the owner of the vehicle to pay the penalty for said <br />violation and the ten dollars ($10.00) for the additional <br />notice within twenty-eight (28) days from the date of <br />violation, shall constitute a violation of this ordinance° Any <br />person convicted of a violation of this ordinance shall be <br />punished by a fine not to exceed one hundred dollars ($100.00). <br /> <br /> <br />
