AN ORDINANCE CLOSING A PORTION OF BART STREET. WHEREAS, the City of Portsmouth, Virginia, desires to vacate, close and discontinue the hereinafter described portion of Bart Street; and WHEREAS, by a resolution of this Council adopted on October 25, 1994, vmewers were appointed pursuanE ~o Sect!on 15.1-364 of the Code of Virginia, 1950, as amended, uo view the hereinafter described portion of said smree5 and to reporu mn writing whether in their opmnmon any, and if any what, inconvenience would result from discontmnuing said portion of Bart Street; and WHEREAS, the said viewers have reported their opinion, no inconvenience would result discontinuing of that portion of Bart Street. mn writing that in in the closing and NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the portion of said street hereinafter described be closed and vacated as a public street: ALL that portion of unimproved Bart Street from its intersection with the easEern right-of-way line of Augusta Avenue (as extended across Bart Street) to the point where the extension of the easEern boundary lines of Lot 17 in Block 57 and Lot 18 in Block 46 on the plat of Virginia Realty and Investment Company intersect the center line of nhe rmght-of-way of Bart Street, said area being 120 feet, more or less, mn length. This vacation and closure is made subject to the rmghts of the City of Norfolk in and to a thirty foot wauer transmission line easemenE granted it by the City of Portsmouth, by Deed dated April 13, 1981, and duly recorded in the Clerk's Office of mhe City of Portsmouth, in Deed Book 805, at page 218. BE IT FURTHER ORDAINED mhat the City of Portsmouth, Virginia, hereby reserves unuo itself a perpetual easemenm, rights and privileges ~o install, operate, maintain and replace sewer mains, sewer drains, sanitary sewers, waEer mains and storm drains over, under and across the hereinabove described portion of Bart Street.
