ZONING AMENDMENT ORDINANCE Z-95-17. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That a portion of the zoning map attached to and made <br />a part of the City of Portsmouth Zoning Ordinance, which now <br />zones as Commercial C-I, the property described in Petition for <br />Zoning Amendment No. Z-94-!7 is hereby amended and changed so <br />as to show said property zoned as Commercial C-2-K, and that <br />said property is hereby zoned as Commercial C-2-K. <br /> <br /> 2. That the property affected by this ordinance by being <br />zoned Commercial C-2-K is described as follows: <br /> <br />Z-95-17 <br /> <br />Beginning at the southwest intersection of <br />Frederick Boulevard and Dahlia Street; thence <br />south along'the western right-of-way of <br />Frederick Boulevard approximately 280 feet to <br />a point, thence northwest 105 feet to a point; <br />thence north approximately 302 feet to a <br />point; thence east along the southern <br />right-of-way of Dahlia Street approximately <br />150 feet to the point of beginning. <br /> <br /> 3. That Zoning Amendment Ordinance Z-95-17 is <br />conditioned upon the following as proffered by the applicants, <br />Donald R. Baker and James A Tinnell: <br /> <br /> (a) The use of the property shall be limited to an auto <br />repair shop. <br /> <br /> (b) The site shall be screened from the adjacent <br />residential properties and Dahlia Street by Group 1 Landscaping <br />buffers as described in the City of Portsmouth Zoning <br />Ordinance. Along Frederick Boulevard, trees and landscaping <br />shall be installed in accordance with the requirements of <br />Section 40-71.2(e) (2) and with the Landscaping Group 5 <br />requirements of Section 40-73 of said Zoning Ordinance. <br /> <br /> (c) Ail underground storage tanks located on the site <br />shall be removed prior to issuance of a certificate of <br />occupancy. <br /> <br /> (d) Ail vehicles stored at the site shall have current <br />license plates, city decals and a state inspection or rejection <br /> <br /> <br />
