ZONING AMENDMENT ORDINANCE Z-95-17. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That a portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance, which now zones as Commercial C-I, the property described in Petition for Zoning Amendment No. Z-94-!7 is hereby amended and changed so as to show said property zoned as Commercial C-2-K, and that said property is hereby zoned as Commercial C-2-K. 2. That the property affected by this ordinance by being zoned Commercial C-2-K is described as follows: Z-95-17 Beginning at the southwest intersection of Frederick Boulevard and Dahlia Street; thence south along'the western right-of-way of Frederick Boulevard approximately 280 feet to a point, thence northwest 105 feet to a point; thence north approximately 302 feet to a point; thence east along the southern right-of-way of Dahlia Street approximately 150 feet to the point of beginning. 3. That Zoning Amendment Ordinance Z-95-17 is conditioned upon the following as proffered by the applicants, Donald R. Baker and James A Tinnell: (a) The use of the property shall be limited to an auto repair shop. (b) The site shall be screened from the adjacent residential properties and Dahlia Street by Group 1 Landscaping buffers as described in the City of Portsmouth Zoning Ordinance. Along Frederick Boulevard, trees and landscaping shall be installed in accordance with the requirements of Section 40-71.2(e) (2) and with the Landscaping Group 5 requirements of Section 40-73 of said Zoning Ordinance. (c) Ail underground storage tanks located on the site shall be removed prior to issuance of a certificate of occupancy. (d) Ail vehicles stored at the site shall have current license plates, city decals and a state inspection or rejection
