ZONING AMENDMENT ORDINANCE Z-95-13 <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That the portion of the zoning map attached to and <br />made a part of the City of Portsmouth Zoning Ordinance which <br />now zones as Commercial C-2-K (Conditional), Office Residential <br />OR-75-K (Conditional) and Residential Multi-Family RM-75-K <br />(Conditional), the property described in Petition for Zoning <br />Amendment Number Z-95-13, is hereby amended and changed so as <br />to show said property zoned as Commercial C-2-K (Conditional), <br />and that said property is hereby zoned as Commercial C-2-K <br />(Conditional). <br /> <br /> 2. That the proPerty affected by this ordinance by being <br />zoned from Commercial C-2-K (Conditional), Office Residential <br />OR-75-K (Conditional) and Residential Multi-Family RM-75-K <br />(Conditional), to Commercial C-2-K (Conditional), is described <br />as follows: <br /> <br /> Z-95-13 <br /> ALL that certain piece or parcel of land, <br />situate in the City of Portsmouth, Virginia, <br />being 33.86 acres as shown on that certain <br />survey entitled "Boundary Survey of Churchland <br />High School, Portsmouth, Virginia," dated <br />March 31, 1987 and revised January 29, 1992, <br />made by Miller-Stephenson & Associates, P.C., <br />which said plat is duly recorded in the <br />Clerk's Office of the Circuit Court of the <br />City of Portsmouth, Virginia, in Map Book 15 <br />at page 84. <br /> <br /> 3. That Zoning Amendment Ordinance Z-95-13 is <br />conditioned upon the following as proffered by the applicant, <br />Development Options, Inc.: <br /> <br /> (a) For purposes of the ordinance, the "Development Site" <br />is more particularly shown on the site plan entitled <br />"Conceptual Site Plan For Shopping Center Former Churchland <br />High School Site," dated May 22, 1995, prepared by Hoggard/Eure <br />Associates, Surveyors/Planners/Engineers, Portsmouth, Virginia, <br />("Site Plan") ~ The Site Plan, identified as Exhibit A, is <br />attached hereto and made a part hereof. <br /> <br /> (b) The building height for the proposed shopping center <br />building will generally not exceed thirty-five (35) feet as <br /> <br /> <br />
