ZONING AMENDMENT ORDINANCE Z-95-13 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance which now zones as Commercial C-2-K (Conditional), Office Residential OR-75-K (Conditional) and Residential Multi-Family RM-75-K (Conditional), the property described in Petition for Zoning Amendment Number Z-95-13, is hereby amended and changed so as to show said property zoned as Commercial C-2-K (Conditional), and that said property is hereby zoned as Commercial C-2-K (Conditional). 2. That the proPerty affected by this ordinance by being zoned from Commercial C-2-K (Conditional), Office Residential OR-75-K (Conditional) and Residential Multi-Family RM-75-K (Conditional), to Commercial C-2-K (Conditional), is described as follows: Z-95-13 ALL that certain piece or parcel of land, situate in the City of Portsmouth, Virginia, being 33.86 acres as shown on that certain survey entitled "Boundary Survey of Churchland High School, Portsmouth, Virginia," dated March 31, 1987 and revised January 29, 1992, made by Miller-Stephenson & Associates, P.C., which said plat is duly recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in Map Book 15 at page 84. 3. That Zoning Amendment Ordinance Z-95-13 is conditioned upon the following as proffered by the applicant, Development Options, Inc.: (a) For purposes of the ordinance, the "Development Site" is more particularly shown on the site plan entitled "Conceptual Site Plan For Shopping Center Former Churchland High School Site," dated May 22, 1995, prepared by Hoggard/Eure Associates, Surveyors/Planners/Engineers, Portsmouth, Virginia, ("Site Plan") ~ The Site Plan, identified as Exhibit A, is attached hereto and made a part hereof. (b) The building height for the proposed shopping center building will generally not exceed thirty-five (35) feet as
