AN ORDINANCE TO AMEND CHAPTEE 24 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ADDING SECTIONS 24-251 AND <br />24-325 THERETO, PERTAINING TO OFFENSES AND MISCELLANEOUS <br />PROVISIONS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Chapter 24 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended by adding thereto, <br />Sections 24-251 and 24-325 to read as follows: <br /> <br />Sec. 24-251. Failure to provide adequate security <br /> or crowd control. <br /> <br /> Any person who has negligently failed to provide adequate <br />security or crowd control an a sporting event, restaurant or <br />other business or commercial activity that draws large crowds <br />of people may be liable in a separane civil action for the cost <br />associated with any emergency response by the police deparnment <br />or emergency medical services personnel of the City caused by <br />the sponsor, owner or nenant of any sporting event, restaurant, <br />nightclub or other business or commercial establishment who <br />negligently failed to provide adequane security or crowd <br />control. Such persons shall be liable to the City in an amount <br />not to exceed one thousand dollars ($1,000.00). <br /> <br />Sec. 24-325. Removal or repair of defacement of <br /> buildings, walls, fences and other structures. <br /> <br /> The Director of Environmental Services may undertake or <br />contract for the removal or repair of defacement of any public <br />building, wall, fence or other structure or any private <br />building, wall, fence or other structure where such defacement <br />is visible from any public right-of-way. Prior to such <br />removal, the director shall seek the written permission of the <br />property owner. Should the property owner fail to provide such <br />permission within ten (10) days, the director may maintain a <br />public nuisance action against the property owner in order to <br />compel the property owner to allow removal or repair of the the <br />defacement. After receiving the written permission or <br />appropriate court order, the director may undertake the removal <br />or repair of the defacement. All such removal or repair shall <br />be at the expense of the City. <br /> <br /> 2. That this ordinance shall take effect on July 1, <br />1995. <br /> <br /> <br />
