(b) The City is authorized by the Code of Virginia to <br />construct, reconstruct, improve and extend a stormwater utility <br />syssem and 5o issue revenue bonds, if needed~ to finance in <br />whole or in part the cos~ of such system and to establish just <br />and equitable rates, fees and charges for the services and <br />facilities provided by the syssem. <br /> <br /> (c) It is necessary and essential that the City provide <br />for effective management and financing of a stormwater syssem <br />within the City 5o provide a mechanism for mitigating the <br />damaging effects of stormwater runoff on the environment and <br />to improve the public health, safety and welfare by providing <br />for the safe and efficient capsure and conveyance of stormwater <br />runoffs the improvement of waser quality, and the correctmon of <br />stormwater problems. <br /> <br /> (d) Stormwater runoff is associated with all developed <br />properties in the City~ whether residential or nonresidential~ <br />and the volume of each individual property's stormwater runoff <br />is related ~o 5he amount of impervious and semi-pervious <br />surface on the property. <br /> <br /> (e) The director shall be responsible for the use, <br />management, operation and maintenance of the smormwaEer system <br />as prescribed by this chapter. He shall have the authority <br />to establish procedures and to enforce regulations pertaining <br />to the stormwater system. <br /> <br />Sec. 31.1-51. Stormwater utility fees. <br /> <br /> (a) The following stormwater utility fees are hereby <br />authorized for all utility customers mn the City~. Rates will <br />be based on the number of Equivalent Residential Units (ERU). <br />An ERU will be the equivalent of 1,877 square feet of <br />impervious area which will include all buildings, structures <br />and other impervious and semi-pervious surfaces which <br />contribute ~o stormwater runoff. The mmnmmum monthly charge <br />shall be equal to one (1) ERU. The number of ERU's will be <br />determined by the Director of Public Works. <br /> <br />Residential accounms .......... 1 ERU x $3°50 <br /> <br />Nonresidential accounts ...... Actual number of ERU's <br /> x $3.50 <br /> <br /> (b) Ail payments for this service shall be the <br />responsibility of the owner. <br /> <br />(c) When new properties are brought into the utility <br /> <br /> <br />
