72 <br /> <br />A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO MAKE A SUBMISSION <br />TO THE U.S. DEPARTMENT OF JUSTICE FOR PRECLEARANCE OF THE <br />ELECTION OF SCHOOL BOARD MEMBERS; AND AUTHORIZING THE CITY <br />ATTORNEY TO SUBMIT ALL INFORMATION NECESSARY FOR SUCH <br />SUBMISSION. <br /> <br /> WHEREAS, the General Assembly of Virginia has provided for <br />the popular election of school boards, Section 22.1-57.1 et <br />seq. of the Code of Virginia, for the purpose of permitting <br />localities to have elected school board members rather than <br />appointed school board members; and <br /> <br /> WHEREAS, the registered voters of the City of Portsmouth, <br />having by referendum approved the selection of school board <br />members by direct election, in accordance with Section <br />22.1-57.2 of the Code of Virginia; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth has held a <br />public work session and two (2) public hearings on the method <br />of electing school board members, and deems it in the best <br />interest of the City to support an at-large method of school <br />board election. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Attorney be, and he <br />hereby is, authorized to make the submission to the U.S. <br />Department of Justice for preclearance under the Voting Rights <br />Act of 1965 for a change from an appointed to an elected school <br />board by the at-large method of election. <br /> <br /> BE IT FURTHER RESOLVED that the City Attorney be, and he <br />hereby is, authorized to submit all information necessary in <br />connection with such submission and to meet all other <br />administrative and reporting requirements as required by the <br />U.S. Department of Justice. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on October 24, 1995. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
