UP-95-15 <br /> <br /> Beginning on the north side of Bain <br /> Street's right-of-way 55'± west of it's <br /> intersection with Williamsburg Avenue; thence, <br /> north 110'± to a point; thence, west 50'± to a <br /> point; thence, south 110'± to a point; thence, <br /> east 50'± to the point of the beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br /> (a) Occupancy of the facility shall be limited to <br /> eight (8) residents, aged fifty-five (55) or <br /> older or with some limits in ability for self <br /> care, and to required staff members. <br /> <br /> (b) Prior to occupancy and at least annually <br /> thereafter, the facility shall request an <br /> inspection by the Fire Prevention Bureau, the <br /> Public Health Department and the Building <br /> Official and shall correct any noted <br /> deficiencies. <br /> <br /> (c) The facility shall comply with all applicable <br /> codes, ordinances and regulations of federal, <br /> state and local governments, and shall obtain and <br /> maintain in effect all necessary licenses and <br /> permits. <br /> <br /> (d) The applicants shall provide two (2) off-street <br /> parking spaces approved by the City Engineering <br /> Department prior to the issuance of a certificate <br /> of occupancy. <br /> <br /> (e) The use permit shall not be transferable. <br /> <br /> (f) Except as hereby amended, the facility shall be <br /> operated in accordance with the narrative <br /> description submitted by the applicants and which <br /> is attached hereto as Exhibit A and made a part <br /> hereof. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at meeting held on September 26, 1995. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
