UP-95-12 <br /> <br /> BEGINNING at the southeastern <br /> intersection of Knox Street and Dahlia Street; <br /> thence east along the southern right-of-way <br /> line of Knox Street 55 feet to a point; thence <br /> south 110 feet to a point; thence west 55 feet <br /> to a point; thence north 110 feet along the <br /> eastern right-of-way line of Dahlia Street to <br /> the point of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br /> (a) Occupancy of the facility shall be limited to <br /> eight (8) ambulatory residents, aged fifty-five <br /> (55) or older, and to required staff members. <br /> <br /> (b) Prior to occupancy and at least annually <br /> thereafter, the facility shall request an <br /> inspection by the Fire Prevention Bureau, the <br /> Public Health Department and the Building <br /> Official and shall correct any noted <br /> deficiencies. <br /> <br /> (c) The project shall be developed in accordance with <br /> submitted site and floor plans as approved by the <br /> City. <br /> <br /> (d) The applicant shall install six-foot high privacy <br /> fencing around the perimeter of the outdoor <br /> recreation area and provide landscaping within <br /> the perimeter. <br /> <br /> (e) The use permit shall not be transferable. <br /> <br /> (f) The facility shall comply with all applicable <br /> codes, ordinances and regulations of federal, <br /> state and local governments, and shall obtain and <br /> maintain in effect all necessary licenses and <br /> permits. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, an meeting held on July 25, 1995. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
