A RESOLUTION GRANTING A USE PERMIT TO JOHN AND CAROL BRALEY FOR <br />THE OPERATION OF A BED AND BREAKFAST INN AT 420 MIDDLE STREET. <br /> <br /> WHEREAS, John and Carol Braley have made application <br />pursuant to Section 40-102.2 (B) (1) of the Code of the City of <br />Portsmouth, Virginia, 1988, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> i. That the use for which the use permit <br />hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the <br />proposed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements of the neighborhood; <br />and <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. That John and Carol Braley are hereby granted a use <br />permit pursuant to Section 40-102.2 (B) (1) of the Code of the <br />City of Portsmouth, Virginia, 1988, for the operation of a bed <br />and breakfast inn on property located at 420 Middle Street and <br />being more particularly described as: <br /> <br /> UP-95-13 <br /> <br /> Beginning at the northwestern <br /> intersection of London Boulevard and Middle <br /> Street; thence north along the western <br /> right-of-way line of Middle Street 120 feet to <br /> a point; thence west 160 feet to a point; <br /> thence south 75 feet to a point; thence east <br /> 15 feet to a point; thence south 45 feet to a <br /> point; thence east 145 feet along the northern <br /> <br /> <br />
