Motion adopted concurrently with Ordinance No. 1997-12 <br /> <br /> That the closing of this portion of Columbia Street be <br />conditioned upon the following: <br /> <br />* Developer obtaining fee simple title to the closed <br />portion of the street by recorded deed, <br /> <br />* Payment to the City of the sum of $2500.00 for the <br />closed portion of the street, and <br /> <br />* Commencement of construction of a Rite-Aid Pharmacy on <br />the adjacent site and the closed portion of the street within <br />four months of this date. Commencement of construction shall <br />be satisfied with approval of the site plan by City staff. <br />At the time all conditions are met, the City Attorney be <br />authorized to record the Ordinance closing said street in the <br />Clerk's Office of the Circuit Court of the City of <br />Portsmouth. <br /> <br /> <br />
