AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ADOPTING A NEW SECTION 40-48.2 <br />PERTAINING TO THE CREATION OF THE EBONY HEIGHTS RESIDENTIAL <br />OPPORTUNITY DISTRICT. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Chapter 40 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended by adding thereto a new <br />Section 4G-48.2 to read as follows: <br /> <br />Section 4G-48.2 Ebony Heights Residential Opportunity District. <br /> <br /> (a) There is hereby created within the city a zoning <br />overlay district to be known as the Ebony Heights Residential <br />Opportunity District, designated RO-1, the boundaries of which <br />are set forth on a map maintained in accordance with Section <br />40-42.1 and &0-48. <br /> <br /> (b) Within the RO-1 district, the Planning Commission <br />may, by special exception, waive the physical development <br />standards applicable to an RS-75 zoning district, in the areas <br />and to the extent permitted below: <br /> <br /> Maximum Allow- <br /> RS-75 able Waiver <br /> <br />Required lot size: 7,500 sq.ft. 20% <br /> <br />Required front footage: 70 feet 20% <br /> <br />Yard setback As applicable* 10% <br /> <br />Subdivision regulations- <br />required lot depth 100 feet 20% <br /> <br />* Yard setbacks applicable to an RS-75 zoning district are <br />established in Table 40-44-2. <br /> <br /> 2. That the boundaries of Ebony Heights Residential <br />Opportunity District (RO-1) shall be as established on Exhibit <br />A, attached hereto and made a pabt hereof. <br /> <br /> <br />
