1997-63 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-22 AND <br />40-43.4 THEREOF PERTAINING TO COMMUNICATIONS TOWERS AND <br />ANTENNAS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-22 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended by amending the <br />definition "Communication Tower" and by adopting a new <br />definition "Communication Antenna" to read as follows: <br /> <br />Sec. 40-22. Specific definitions. <br /> <br /> Communication tower. Any tower or antenna structure and <br />its appurtenances erected on a lot or attached to another <br />structure that supports broadcast and receiving equipment for <br />commercial purposes. <br /> <br /> Communication antenna. Any structure or device, used for <br />the purpose of collecting and/or transmitting electromagnetic <br />waves for commercial purposes. <br /> <br /> 2. That Conditions (59) and (62) contained in Section <br />40-43.4 of the Code of the City of Portsmouth, Virginia (1988) <br />be amended and reordained to read as follows: <br /> <br />Sec. 40-43.4. Conditions for specific uses. <br /> <br /> The following conditions apply to the specified uses, as <br />indicated in the "Condition" column on the use schedule: <br /> <br /> (59) (a) Limited to commercial communication towers or <br /> antennas and accessory suructures for telephone <br /> communications, telegraph communication, radio <br /> and television broadcasting, cable television <br /> services and other similar communication <br /> services. The use permit requirement does not <br /> apply to any City-owned sites preapproved by the <br /> City Council. <br /> <br /> (b) Antennas and accessory equipment placed on an <br /> existing tower, building or other structure are <br /> exempt from the use permit requirement. <br /> However, such placement is subject to approval <br /> by the Director of the Department of Community <br /> Quality and Planning Services after submittal of <br /> required information including a site plan and <br /> elevations.
