98-2 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTIONS 40-52.1 (a) <br />AND 40-52.7 (e) (2), (c) (3), AND (c) (10) PERTAINING TO BED AND <br />BREAKFAST INNS IN THE PORT NORFOLK HISTORIC DISTRICT. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 40-52.1 (a) and 40-52.7 (c) (2), (c) (3), <br />and (c) (10) of the Code of the City of Portsmouth, Virginia <br />(1988) be amended and reordained to read as follows: <br /> <br />Sec. 40-52.1. Historic district; uses. <br /> <br /> Permitted uses shall be governed according to three <br />sub-districts, as shown on the Historic District Map: <br /> <br /> (a) HISTORIC RESIDENTIAL. Uses shall be limited to <br />single family dwellings, duplexes or multi-family dwellings, <br />and in the Olde Towne and Port Norfolk Historic Districts, bed <br />and breakfast inns as provided for in Section 40-52.7. <br /> <br />Sec. 40-52.7. Bed and breakfast inns. <br /> <br /> (2) Two (2) off-street parking spaces for the <br /> owner/manager and one (1) off-street space per <br /> guest room shall be required. In the Port Norfolk <br /> Historic District, City Council may reduce or <br /> eliminate the requirement for two off-street <br /> parking spaces for the Owner/Manager; however, <br /> there shall be no less than two off-street parking <br /> spaces provided for each inn. The front yard shall <br /> not be used for parking. If parking cannot be <br /> provided on the site, it must be provided within <br /> 300 feet of the site. <br /> <br /> (i) There shall be no parking by guests on <br /> the streets. <br /> (ii) The municipal parking areas in Olde <br /> Towne Parking District may be used to <br /> satisfy the above requirement with the <br /> approval of and the issuance of parking <br /> passes by the Portsmouth Parking <br /> Authority. <br /> (iii) All parking passes provided to the owner <br /> of the facility by the Portsmouth <br /> Parking Authority shall be accounted for <br /> by the owner's keeping of a record which <br /> <br /> <br /> <br /> <br /> <br /> <br />
