AN ORDINANCE TO AMEND CHAPTER 37 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY REPEALING SAID CHAPTER AND <br />ENACTING A NEW CHAPTER 37 THERETO PERTAINING TO VEHICLES FOR <br />HIRE. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Chapter 37 of the Code of the City of Portsmouth, Virginia (1988) is hereby <br />repealed, and that a new Chapter 37, entitled "Vehicles for Hire," be hereby adopted to read as <br />follows: <br /> <br /> Chapter 37 <br /> VEHICLES FOR HIRE <br /> <br /> ARTICLE I. IN GENERAL <br /> <br />Sec. 37-1. Use of offensive language by operator. <br /> <br /> It shall be unlawful and a Class 3 misdemeanor for the driver or operator of any <br />automobile or other vehicle transporting passengers for pay to use any insulting, offensive, <br />obscene, profane or threatening language toward or in the presence of any passenger in such <br />vehicle. Upon conviction of such offense, the court or jury trying the case may, in addition to <br />imposing the penalty provided for the offense, declare the license or permit of such person <br />revoked. <br /> <br />Secs. 37-2--37-20. Reserved' <br /> <br /> ARTICLE II. TAXICABS AND OTHER PUBLIC VEHICLES <br /> <br /> DIVISION 1. GENERALLY <br /> <br />Sec. 37-21. Definitions. <br /> <br /> The following words, terms and phrases, when used in this article shall have the <br />meanings ascribed to them in this section, except where the context clearly indicates a different <br />meaning: <br /> <br />Chief of police. The term "chief of police" shall mean the chief of police of the city or his or her <br />designee. <br /> <br />Driver. The word "driver" shall mean the person who drives a taxicab or other vehicle for hire. <br /> <br />Operator. The word "operator" shall mean the person in charge of the driver(s) of a taxicab or <br />other vehicle for hire. <br /> <br /> <br />
