AN ORDINANCE CLOSING AND VACATING A PORTION OF GLASGOW STREET LYING EAST OF THE EASTERN RIGHT OF WAY LINE OF CRAWFORD STREET AND WEST OF THE WESTERN RIGHT OF WAY LINE OF WATER STREET. WHEREAS, the City of Portsmouth and Citizens Trust Associates, L.L.P., a Virginia Limited liabiIity partnership have made application to close and vacate a portion of Glasgow Street, as hereinafter described; and WHEREAS, the Planning Commission, at a meeting held on November 3, 1998, recommended approval of the closing and vacating of said streets and roads; and WHEREAS, notice of the proposed closure has been given adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, 1950, as amended. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia that the portion of Glasgow Street be closed and vacated as a public street, and right of way as follows: All that certain portion of Glasgow Street located and being in the City of Portsmouth, Virginia, said portion lying east of the eastern right of way line of Crawford Street and west of the western right of way line of Water Street. BE IT FURTHER ORDAINED that a perpetual easement is hereby reserved unto the City of Portsmouth in that portion of Glasgow Street hereby closed and vacated for the installation, operation, maintenance and replacement of utilities owned and operated by the City of Portsmouth and private utilities, which said easement may be closed and vacated by the City Manager as he may in his discretion deem appropriate, and in the best interest of the City of Portsmouth. BE IT FURTHER ORDAINED that the City manager is hereby authorized to make and execute such deeds of conveyance or other documents as may be necessary and appropriate to give effect to the vacations and closures implemented by this ordinance. This ordinance shall be effective immediately upon its adoption.
