d. All structures associated with the funeral home must be located so as not to require access from an interior residential street and may not be located in any required yard in OR-75 and if in C-1 must comply with Section 40-43.5 3. That Section 40-45.6 of the Code of the City of Portsmouth, Virginia (1988) be amended to read as follows: Sec. 40-45.6. Restrictions on parking of commercial vehicles and parking of mobile construction equipment. The parking of a commercial vehicle as defined in Section 40-22 and the parking or storage of mobile construction equipment as defined in Section 40-22 is prohibited in any residential district, or subdistrict and in an Office Residential OR-75- District, except that one (1) cormmercial vehicle used by a resident of the premises may be parked on any lot on which there is located a main building provided that such vehicle is parked in an enclosed garage, accessory building, carport or on an asphalt or concrete driveway. This prohibition shall not be interpreted to prohibit commercial vehicles from loading and unloading in any residential district nor to prohibit mobile construction equipment from being parked or stored while the equipment is actually engaged in the provision of services at the location where it is parked or stored. The parking of school buses shall be permitted on school property. 4. That Section 40-164 of the Code of the City of Portsmouth, Virginia (1988) is hereby repealed. 5. That Table 40-43.1-2 of the Code of the City of Portsmouth, Virginia (1988) be amended to allow the use "Funeral Homes and Crematories" (S.I.C. 726) in Office Residential 0R-75 and Commercial C-1 zoning districts, subject to the requirements of Condition 50 set out in Section 40-43.4. 6. That Table 40-43.1-1-3 of the Code of the City of Portsmouth, Virginia (1988) be amended to allow the use "Antique Store" {S.I.C. 5932) in the Downtown D-1-CB Central Business, Downtown D-2-CB Central Business, Downtown D-1-C Commercial, Downtown D-2-C Commercial, Downtown D-1-M Mixed Use, Downtown D- 2-M Mixed Use, Downtown D-1-I Industrial, and Downtown D-2-I Industrial zoning subdistricts, subject to the requirements of Parking Group 12 set out in Section 40-45. 7. That this ordinance shall take effect on the date of its adoption.
