AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-22, 40-43.4, AND 40-45.6 AND TABLE 40-43.1-3 AND BY REPEALING SECTION 40-164 THEREOF PERTAINING TO FUNERAL HOMES AND TO COMMERCIAL VEHICLES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the definition of "Commercial Vehicle" contained in Section 40-22 of the Code of the City of Portsmouth, Virginia (1988) be amended to read as follows: Sec. 40-22. Specific Definitions. COMMERCIAL VEHICLE. A truck, bus, or other self-propelled vehicle of any type or a container constructed for the transportation of materials used or maintained primarily for business purposes to transport goods, equipment or passengers. This definition is not applicable to a vehicle described as a pick-up, van or panel truck, that does not exceed one (1) ton in manufacturer's rased capacity and does not exhibit a company name or logo. 2. That Section 40-43.4 of the Code of the City of Portsmouth, Virginia (1988} be amended by adding thereto a new condition (50) no read as follows: Sec. 40-43.4. Conditions for specific uses. (50) Funeral homes in C-1 and 0R-75 zoning districts are subject no the following conditions: a. Funeral homes in an 0R-75 and C-1 zoning district must have their principal frontage, access and orientation directly on an arterial street. b. When a parcel or a portion of a parcel abuts or is across the street from a residentially zoned property, that parcel or portion of a parcel must be screened from a residentially zoned property, with a landscaping Group 1 buffer. c. Site signs shall be oriented towards the arterial street from which access is chosen. Signage shall not be oriented towards a residential street.
