AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 33-2, 33-34, AND <br />33-58 THEREOF AND BY ADOPTING A NEW SECTION 33-38 PERTAINING <br />TO IN-FILL SUBDIVISIONS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 33-2 of the Code of the City of Portsmouth, Virginia (1988) <br />be amended by adding thereto the definition of "Subdivision, in-fill" to read as follows: <br /> <br />Sec. 33-2. Definitions. <br /> <br />Subdivision, in-fill. A minor subdivision of three or fewer contiguous residential lots <br />located in a recorded subdivision where the majority of platted lots have dimensional <br />characteristics which exceed the minimum requirements of the underlying zoning <br />classification. <br /> <br /> 2. That Sections 33-34 (a) and 33-58 of the Code of the City of Portsmouth, <br />Virginia (1988) be amended to read as follows: <br /> <br />Sec. 33-34. Minor subdivision standards. <br /> <br />(a) The planning director may certify a subdivision or resubdivision as a "minor <br /> subdivision" if he finds that: <br /> 1. The subdivision meets the definition of minor subdivision set forth in Chapter 33, <br /> Article II of this code and existing facilities will adequately accommodate the <br /> modification; and <br /> 2. The proposal meets all requirements with respect to lot sizes and area of the <br /> zoning ordinance, and of this chapter, and that the said proposal will not create a <br /> violation of any of the provisions of the zoning ordinance; and <br /> 3. The proposal will not adversely affect the development of the remainder of the <br /> parcel or any of the adjoining property. <br /> 4. In the case of an in-fill subdivision, the provisions of Section 33-38 are met. <br /> <br />Sec. 33-58, Minor subdivision procedure. <br /> <br /> (a) The planning director may certify a subdivision or a re-subdivision plat as a minor <br /> subdivision or an in-fill subdivision, if he finds that it meets the standards for minor <br /> or in-fill subdivisions set forth in Article II of this chapter. <br /> <br /> <br />
