AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 30-116, 30-118, 30-120, <br />30-236(a), 30-238, AND 30-240 THEREOF PERTAINING TO EMPLOYEE <br />RETIREMENT SYSTEMS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That subsections (a),(d), and (e) of Section 30-116 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and that a new subsection (f) thereto be adopted to read <br />as follows: <br /> <br /> Sec. 30-116. Service retirement. <br /> <br /> (a) Any member, in service or within ninety days after termination of service, who <br />has attained the age of fifty,five (55) and who has attained the number of years of creditable <br />service required for entitlement to benefits under the vesting provisions of this section may retire <br />at any time then or thereafter upon written notification to the board, made by the member or his <br />employer, setting forth at what time the retirement is to become effective; provided that such <br />effective date shall be after his last day of service, but shall not he more than ninety (90) days <br />prior to or subsequent to the filing of such notice. <br /> <br /> (d) Any member, in service or within ninety days after termination of service, who <br />has attained the age of fifty-five (55), and who has attained not less than thirty (30) years of <br />creditable service, may retire at any time then or thereafter upon written notification to the board, <br />made by the member or his employer, setting forth the time the retirement is to become effective; <br />provided that such effective date shall be after his last day of service, but shall not be more than <br />ninety (90) days prior to or subsequent to the filing of such notice. <br /> <br /> (e) Any member, in service or within ninety days of termination of service, who has <br />attained the age of fifty (50) years of age and who has at least ten (10) years of creditable service; <br />may retire with a reduction in benefits at any time upon written notification to the board, made <br />by the member or his employer, setting forth the time the retirement is to become effective; <br />provided that such effective date shall be after his last day of service but shall not be more than <br />ninety (90) days prior to or subsequent to the filing of such notice. Additionally, any member <br />retiring under this subsection shall receive a reduction in his retirement benefits equal to one-half <br />of one (0.5) percent per each month that the employee retires prior to attaining age fifty-five (55). <br /> <br /> (f) Upon a showing of good cause, the Board may waive the ninety-day notification <br />requirement of subsections (a), (d) and (e) relating to the period after termination of service. For <br />purposes of this subsection, good cause shall be deemed to exist if a member who is otherwise <br />eligible to apply for service retirement has first applied for disability retirement, and the <br />application has been denied. <br /> <br /> 2. That Sections 30-I 18, 30-120, 30-236(a), 30-238, and 30-240 of the Code of the <br />City of Portsmouth, Virginia (1988) be amended and reordained to read as follows: <br /> <br /> <br />
