AN ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING ARTICLE XXIII THEREOF <br />TO CREATE A NEW CITY DEPARTMENT OF BEHAVIORAL HEALTHCARE <br />SERVICES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Article XXIII of Chapter 2 of the Code of the City of Portsmouth, <br />Virginia (1988) be amended and reordained to read as follows: <br /> <br /> ARTICLE XXIII. DEPARTMENT OF BEHAVIORAL <br /> HEALTHCARE SERVICES <br /> <br /> DIVISION I. GENERALLY <br /> <br />Sec. 2-711. Established. <br /> <br /> There is hereby established a department of the city government known and <br />designated as the department of behavioral healthcare services. The depaRTmeNT shall <br />consist of a director who shall be appointed by the city manager and other such <br />employees as may be provided or required by law or by the city manager consistent <br />therewith. The director and the department shall engage in such activities and shall have <br />such responsibilities as may be required by law or assigned by the city manager. <br /> <br />2-712. Definitions. <br /> <br /> As used in this article: <br /> <br />"Board" shall mean the behavioral healthcare services advisory board. <br /> <br />"Consumer" shall means a current or former direct recipient of public or private mental <br />health, mental retardation or substance abuse treatment or rehabilitation services. <br /> <br />"Department" shall mean the city's department of behavioral healthcare services. <br /> <br />"Director" shall mean the director of the department of behavioral healthcare services. <br /> <br />"Family member" shall mean an immediate family member of a consumer or the <br />principal caregiver of a consumer. A principal caregiver is a person who acts in the place <br />of an immediate family member, including other relatives and foster care providers, but <br />does not have proprietary interest in the care of the consumer. <br /> <br /> <br />
