R-98-19 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br />PROPERTY OWNED BY B AND K ASSOCIATES, ALSO KNOWN AS B & K <br />ASSOCIATES, A VIRGINIA GENERAL PARTNERSHIP AND BISSETT <br />REALTY, INC. A VIRGINIA CORPORATION UNDER EMINENT DOMAIN <br />PROCEEDING PURSUANT TO THE CHARTER OF THE CITY OF <br />PORTSMOUTH, SAID PROPERTY BEING NECESSARY FOR RIGHT OF WAY <br />TO BE KNOWN AS HARRELL STREET. <br /> <br /> WHEREAS, the Council of the City of Portsmouth has determined it to be in the <br />public interest to acquire and construct a right of way to known as Harrell Street in the <br />Parkview area of the City; and <br /> <br /> WHEREAS, the City and the Owners have not yet been able to agree upon a <br />purchase price to be paid for property necessary to the project; and <br /> <br /> WHEREAS, the advancement of the work and the use of said property will be <br />unreasonably delayed if said property is not made available for the project as soon as <br />possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> That the City Attorney be, and he hereby is, directed to institute eminent domain <br />proceedings against the hereinalter-described property situate in the City of Portsmouth, <br />Virginia, for the purpose of acquiring fee simple title thereto pursuant to Section 2.06, <br />2.07 and 2.08 of the Charter of the City of Portsmouth, Virginia, as amended, and to <br />deposit with the Clerk of the Circuit Court of the City of Portsmouth as provided by law a <br />certificate that the City of Portsmouth will pay the sum designated hereinafter as ordered <br />by the Court to compensate the owners of the property designated and shown as "Exhibit <br />Showing Property To Be Condemned For Harrell Street Extension Owned By B and K <br />Associates and Bissett Realty, Inc., Portsmouth, Virginia," made by Stephen I. Boone & <br />Associates, P.C., Land Surveyors, dated March 30, 1998, a copy of which plat is attached <br />hereto and made a part hereof, but the City Attorney shall not proceed to exercise the <br />right of eminent domain until such time as he has made a bona fide offer to purchase said <br />property, which said offer has been rejected by the owners thereof have rejected, or failed <br />to answer. <br /> <br />The name of the property owners are B and K Associates and Bissett Realty, Inc. <br /> <br /> The amount to be deposited to the credit of the Clerk of the Circuit Court of the <br />City of Portsmouth is $5,400.00. <br /> <br /> <br />
