AN ORDINANCE CLOSING AND VACATING A PORTION OF APPLE <br />STREET LOCATED BETWEEN KING STREET AND COUNTY STREET. <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority and New Mount <br />Olivet Baptist Church have requested the closure of that portion of Apple Street located <br />between King Street and County Street, as hereafter described; and <br /> <br /> WHEREAS, the Planning Commission. at a meeting held on June 5, 2001, <br />recommended approval of the closure and vacation of said portion of Apple Street; and <br /> <br /> WHEREAS. notice of the proposed closure and vacation has been given the <br />adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia. <br />as amended. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Portsmouth. Virginia that a portion of Apple Street be closed and vacated as a public <br />street and fight of way as follows: <br /> <br /> APPLE STREET <br /> <br />All that portion of Apple Street from its intersection with the southem <br />fight of way line of King Street southerly to its intersection with the <br />northern right of way line of County Street. being approximately 245 feet <br />in length and having a 12-foot pavement width. Apple Street having a 30- <br />foot right-of-way. <br /> <br /> BE IT FURTHER ORDAINED, that the City of Portsmouth hereby reserves an <br />easement in the portions of Apple Street hereby closed and vacated for the installation, <br />operation, maintenance and replacement of pubtic utilities, which said easements may be <br />released and vacated by the City Manager of the City of Portsmouth as he may in his <br />discretion deem appropriate and in the best interest of the City of Portsmouth. <br /> <br /> BE IT FURTHER ORDAINED, that this Ordinance shall not become effective <br />unless.a determination has been made by the Planning- Director of the City of Portsmouth <br />that the applicants for the closure of this street have submitted plans for the improvement <br />of the area Closed and vacated hereby which have met with his approval and have posted <br />good and sufficient bond to insure the performance of the construction of said <br />improvemems and have paid unto the City compensation for the vacation and closure <br />described herein not to exceed $900.00 prior to October t, 2001. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />July 10, 2001. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
