AN ORDINANCE TOAMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988)BY AMENDING SECTIONS 23-!, 23-4, 23- <br />8(b), 23-26, 23-27, 23-28, 23-29, 23-30, 23-46, 23-48 AND 23-50 THEREOF, BY <br />ENACTING NEW SECTIONS 23-10 AND 23-91 THROUGH 23-96 THERETO, <br />AND BY REPEALING SECTIONS 23-3 AND 23-49, THEREOF PERTAINING <br />TO NUISANCES. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Sections 23-1, 23-4. 23-8(b), 23-27, 23-28, 23-29, 23-30, 23-46, 23-48 <br />and 23-50 of the Code of the City of Portsmouth. Virginia (1988) be amended and <br />reordained te read as follows: <br /> <br />Sec. 23-1. Definitions. <br /> <br /> The following words, terms and phrases, when used in this chapter, shall, have the <br />meanings ascribed to them in this section, except where the context clearly indicates a <br />different meaning: <br /> <br /> Affidavit means the affidavit prepared by a locality in accordance with §23-91 of <br />this Chapter. <br /> <br /> Alley means a public way, other than a street, designed for vehicular or pedestrian <br />travel to provide access to or from the rear or side of the property. <br /> <br /> Controlled substance means the same as that term is defined in §54.1-3401 of the <br />Code of Virginia. <br /> <br /> Corrective action means the taking of steps which are reasonably expected to be <br />effective to abate drug blight on real property, such as removal, repair or securing of any <br />building, wall or other structure. <br /> <br /> Debris means dead or dying standing weeds, parts of a tree which have fallen due <br />to natural causes or otherwise, trash, junk, discarded or abandoned parts of vehicles, <br />appliances or machinery or any ether material or substance including "non-weather <br />resistant materials" exposed to the elements which may constitute a nuisance or provide a <br />harbor for snakes or rats or anything or any condition which may be a fire menace or <br />breeding place for mosquitoes, give off obnoxious or offensive odors or endanger the <br />health or safety of the residents of the city. <br /> <br /> Director means the director of Planning and Inspections and his representatives. <br />when duly authorized by him to administer and enforce the provistons of this chapter. <br /> <br /> Drug blight means a condition existing on real property which tends to endanger <br />the public health or safety of residents of the city and is caused by the regular presence on <br />the property of persons under the influence of controlled substances or the regular use of <br /> <br /> <br />
