AN ORDINANCE CLOSING AND VACATING AN UNIMPROVED ALLEY BETWEEN CHAUTAUQUA AVENUE AND MARYLAND AVENUE, BOUNDED ON THE NORTH BY THE SOUTH RIGHT OF WAY LINE OF WOODROW STREET, AND ON THE SOUTH BY THE SOUTHERN BOUNDARY LINE OF JERRE G. ASHBERRY, IF EXTENDED EAST AND WEST ACROSS SAID ALLEY. WHEREAS, Jerre G. Ashberry has made application to close an unimproved alley between Chautauqua Avenue and Maryland Avenue, as hereafter described; and WHEREAS, the Planning Connmission, at a meeting held on May 1, 2001, recommended approval of the closure and vacation of said alley; and WHEREAS, notice of the proposed closure and vacation has been given the adjoning property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia that the unimproved alley between Chautauqua Avenue and Maryland Avenue be closed and vacated as follows: UNIMPROVED ALLEY BETWEEN CHAUTAUOUA AVENUE AND MARYLAND AVENUE All that certain alley which lies between Chautauqua Avenue and Maryland Avenue, and which is bounded on the north by the south right of way line of Woodrow Street, and on the south by the southern boundary line of properties of Jerre G. Ashberry, if extended east and west across said alley. BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an easement in the portion of said alley hereby closed and vacated for storm sewer lines of the City of Portsmouth, Virginia, which said easement may be released and vacated by the City Manager of the City of Portsmouth as he may in his discretion deem appropriate and in the best interest of the City of Portsmouth.
