(a) The city treasurer is authorized to issue, without payment of any license <br />fee imposed by this article, to any person who is on active military duty and is in this city <br />solely by reason of military orders and whose legal residence or domicile is a state other <br />than Virginia, a city sticker or decal for identification purposes for each motor vehicle, <br />trailer or semitrailer of which he is the sole owner and which is normally garaged, stored <br />or parked within the city limits, provided such motor vehicle, trailer or semitrailer is <br />registered and titled in the commonwealth solely in such person's name or a Virginia <br />license has been purchased for such vehicle. In the event it cannot be determined where <br />such vehicle is normally garaged, stored or parked, situs, for the purpose of this section, <br />shall be the city of Portsmouth when the vehicle is registered with the state department of <br />mof6rvehicles, utilizing a mailing address in the city. <br /> <br /> (b) The burden of proof shall rest with the owner of the motor vehicle, trailer <br />or semitrailer to present sufficient evidence in the form of a current Leave and Earnings <br />Statement to the city treasurer that the sole owner of the vehicle is on active military <br />duty, is in the city solely by reason of military orders and his legal residence or domicile <br />is a state other than Virginia. If such person fails to do so, he shall be subject to the <br />license fees imposed by this article. <br /> <br /> (c) The issuance of a sticker or decal as provided in this section is essential to <br />the functioning of the vehicle licensing laws of the city <br /> <br /> 2. That there is hereby adopted a new Section 22-93 to the Code of the City <br />of Portsmoutl% Virginia (1988) to read as follows: <br /> <br />Sec. 22-93. Issuance of sticker or decal for vehicle owned by disabled veteran. <br /> <br /> No license fee shall be charged for a sticker or decal issued to any one motor vehicle <br />owned and used personally by any veteran who holds a current state motor vehicle registration <br />card establishing that he has received a disabled veteran's exemption from the department of <br />motor vehicles and has been issued a disabled veteran's motor vehicle license plate as prescribed <br />in Section 46.2-739 of the Code of Virginia. <br /> <br />3.
