AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-43,4(1), 40- <br />52.1(a) AND TABLES 40-43-1, 40-43.1-2, 40-43.1-3 AND 40~44.2 AND BY <br />ADOPTING NEW SECTIONS 40.162 AND 40-43.7 PERTAINING TO ZONING. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Sections 40.43.4(1) and 40-52.1(a) of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to mad as follows: <br /> <br />Sec. 40-43.4. Conditions for specific uses. <br /> <br /> (1) Limited to accessory uses and structures which would not create a <br />nuisance or hazard and are customarily incidental to any permitted residential use such as <br />garages, greenhouses or workshops, provided that none shall be inhabited. Accessory <br />structures shall not exceed 25% of the area ofthe primary building footprint and shall <br />not exceed the height of the primary structure. Tractor trailers, automobiles, trucks and <br />metal containers designed for freighi and cargo are prohibited as accessory structures in <br />residential zoning districts. <br /> <br />Sec. 40-52.1. Historic district; uses. <br /> <br /> Permitted uses in the historic district shall be governed according to three (3) sub- <br />districts, as shown on the zoning map: <br /> <br />(a) Historic residential Uses shall be limited to single-family dwellings, <br />duplexes or multifamily dwellings, and family care residences for adults <br />and children and in the Olde Towne and Port Norfolk Historic Districts, <br />bed and breakfast inns as provided for in section 40-52.7. Churches, <br />schools, day-care centers and two-family dwellings, multifamily dwellings <br />and attached row dwellings shall be permitted only upon issuance of a use <br />perrmt. A single dwelling unit in a building used as a church or school <br />shall be permitted ordy upon issuance of a use permit that specifies that <br />purpose. <br /> <br /> 2. That new Sections 40-43.7 and 40-162 to the Code of the City of <br />Portsmouth, Virginia (1988) be adopted to read as follows: <br /> <br />Section 40-43.7. Open Storage- CommerciaI Districts. <br /> <br /> The outside storage of any equipment, vehicle, materials or supplies in <br />commercial zoning districts shall be permitted only within an area completely screened <br />from view and architecturally compatible with the building(s) on the site. The use of <br />tractor trailers or metal freight containers for enclosed storage is prohibited. <br /> <br /> <br />
