requirements shall not be artificially divided so as to constitute a small purchase under this <br />section. Purchases under this section that are expected to exceed $30,000 shall require the <br />written informal solicitation of a minimum of four bidders or offerors. Awards shall be <br />made to the business offering the lowest acceptable quotation. The name of the business <br />submitting the quotation and the date and the amount of such quotation shall be recorded <br />and maintained as a part of the contract file. <br /> <br />b. A single quotation or term contract may be accepted from any one source in contracts <br />which de not exceed $5,000. <br /> <br />Sec. 12-278. Negotiation for professional services. <br /> <br />Professional services shall be procured by competitive negotiation when the cost of the <br />professional services is expected to exceed $30,000 for the aggregate of single or term <br />contracts for professional services. The purchasing agent and representative of the using <br />agency shall engage in individual discussions with' all offerors deemed fully qualified, <br />responsible and suitable on the basis of initial responses, with emphasis on professional <br />competence, to provide the required services. Repetitive formal interviews shall be <br />permissible. Such offerors shah be encouraged to elaborate on their qualifications and <br />performance data or staff expettise pertinent to the proposed project, as well as alternative <br />concepts. The request for proposals shall not, however, request that offerors furnish <br />estimates of man-hours or cost for services. At the discussion stage, nonbinding estimates <br />of total project cost, including, where appropriate, design construction and life cycle <br />costing, may be discussed. Proprietary information from competing offerors shall not be <br />disclosed to the public or to competitors. At the conclusion of discussion outlined herein, <br />on the basis of evaluation factors published in the request for proposal and all information <br />developed in the selection process to this point, the purchasing agent shall select, in the <br />order of preference, two (2) or more offerors whose professional qualifications and <br />proposes services are deemed most meritorious. Negotiations shall then be conducted, <br />beginning with the offeror ranked first. If a contract satisfactory and advantageous to the <br />city can be negotiated at a price considered fair and reasonable, the award shall be made to <br />that offeror. Otherwise, negotiations with the offeror ranked first shall be formally <br />terminated and negotiations conducted with the offeror ranked second, and so on until such <br />a contract can be negotiated ar a fair and reasonable price. Should the purchasing agent <br />determine in writing that, in his sole discretion, only one (1) offeror is fully qualified or <br />that one (1) offeror is clearly more highly qualified and suitable than the others under <br />consideration, a contract may be negotiated and awarded to that offeror. <br /> <br />2. That Section 12-252 of the Code of the City of Portsmouth, Virginia (1988) be <br />amended by adding thereto a new subsection (d) to read as follows: <br /> <br />Sec. 12-252.
