(d) The minimum square footage of the apartments will be 750 square feet. <br /> <br />(e) All lighting of the parking lot must be directed away from the abutting <br />properties. <br /> <br />(f) A minimum of 27 on-site parking spaces will be provided. <br /> <br />(g) Prior to the rehabilitation of the structure, the site must be subdivided. <br /> <br />(h) If a building permit for the project has not been approved within one year <br />of the City Council approval, the project approval will be deemed expired <br />unless extended by City Council. <br /> <br />(i) The applicant and any successor in interest shall comply with all <br />applicable statutes, ordinances and regulations of federal, state and local <br />governments and shall obtain and maintain in effect all required permits. <br /> <br />(j) All rexes in connection with the property shall be paid when due. <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section 40- <br />115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails m apply for all building permits for the entire project <br />within one year of the adoption of this resolution. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the permit by the City Council. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />February 27, 2001. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
