Said deed shall provide for the following: Title to this shall revert to the City of <br />Portsmouth, Virginia in fee simple absolute if VDOT's use of the property ever becomes <br />unnecessary by virtue of the uses of same being abandoned; that the property so transferred shall <br />be placed in a permanent conservation easement or other restrictive easement designed to protect <br />Portsmouth's potable water reservoirs; and that the property will be managed and maintained to <br />prevent sedimentation and pollution of Portsmouth potable water reservoirs. <br /> <br /> Parcel 3: <br /> <br /> Parcel 017 - Being as shown on Sheets 7 and 8 of the plans for the Southwest Suffolk <br />Bypass, State Highway Project R000-06t-F01, RW 201 and beginning on both sides of the <br />survey centerline from the lands now or formerly belonging to the Department of Highways and <br />Transportation of the Commonwealth of Virginia at approximate station 1063+65 to the lands <br />now or formerly belonging to Nations Bank Trust at approximate Station 1076+37 and <br />containing 6.311 acres, more or less, land. <br /> Said deed shall provide for the following: Title to this property shall revert to the City of <br />Portsmouth, Virginia in fee simple absolute if VDOT's use of the property ever becomes <br />unnecessary by virtue of the uses of same being abandoned; that the property so transferred shall <br />be placed in a permanent conservation easement or other restrictive easement designed to protect <br />Portsmouth's potable water reservoirs; and that the property will be managed and maintained to <br />prevent sedimentation and pollution of Portsmouth's potable water reservoirs. The use of this <br />property by VDOT will not in any manner, interfere with Portsmouth's continued use of Lake <br />Kilby as a potable water reservoir, nor restrict the free flow of Lake Kilby, nor preclude <br />Portsmouth's right of ingress/egress beneath the bridge to be constructed across Lake Kilby. <br /> <br /> Parcel 3A <br /> <br /> Any and all easements of access, light or air, incident to the lands of the Grantor abutting <br />upon the Limited Access Highway, and/or upon any of its ramps, loops, or connections at and <br />with intersecting highways, the line or lines along which easements herein conveyed lie being <br />described as follows: <br /> From a point on the proposed south right of way and limited access line opposite <br />approximate survey centerline Station 1063+50, the lands now or formerly belonging to the <br />Department of Highways and Transportation of the Commonwealth of Virginia; thence along <br />said proposed south right of way and limited access line to a point opposite approximate Station <br />1076+50, the lands now or formerly belonging to Nation's Bank Trust; also from a point on the <br />proposed north right of way and limited access line opposite approximate survey centerline <br />Station 1064+05, the lands now or formerly belonging to the Department of Highways and <br />Transportation of the Commonwealth of Virginia; thence along said proposed north right of way <br />and limited access line to a point opposite approximate Station 1076+12, the lands now or <br />formerly belonging to Nations Bank Trust. <br /> This conveyance is to be made pursuant to the provisions of Article 4, Chapter 1, Title <br />33.1, of the 1950 Code of Virginia, as amended, which shall be a covenant running with the <br />abutting lands of the Grantor, which abut upon the Limited Access Highway, and/or upon any of <br />its ramps, loops, or connections at or with intersecting highways, along the line or lines <br />hereinabove described, as if the Article, as amended, were herein fully recited.
