R-01-14 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE DEEDS OF <br />CONVEYANCE, NECESSARY EASEMENTS FOR ACCESS, LIGHT OR AIR, A <br />PERMANENT EASEMENT FOR DRAINAGE FACILITIES AND TEMPORARY <br />CONSTRUCTION EASEMENTS TO THE COMMONWEALTH OF VIRGINIA FOR <br />PARCELS OF LAND IN THE CITY OF SUFFOLK NECESSARY TO THE <br />CONSTRUCTION OF THE SOUTHWEST SUFFOLK BYPASS AND THE WIDENING <br />OF MURPHY'S MILL ROAD (STATE ROUTE 638), AND TO ACCEPT A DEED FROM <br />THE COMMONWEALTH OF VIRGINIA TO THE CITY OF PORTSMOUTH FOR <br />LANDS IN THE CITY OF SUFFOLK BEING CONVEYED TO THE CITY OF <br />PORTSMOUTH IN EXCHANGE. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City <br />Manager be, and he hereby is, authorized to execute deeds of conveyance to the Commonwealth <br />of Virginia for lands located inthe City of Suffolk, Virginia, which lands are described as <br />follows, to-wit: <br /> <br /> Parcel 1: <br /> <br /> Parcels 001 and 024 - Being as shown on sheets 4 and 5 of the plans for Route 638, State <br />Highway Project 0638-061-294, C501 and beginning on the south (right) side of Route 638 <br />construction centerline, from a point opposite approximate Station 143+92, and ending on both <br />sides of said centerline at approximate Station 150+85, the lands now or formerly belonging to <br />Mary B. Marlins, said area containing 0.484 acre, more or less, land: <br /> Together with the prescriptive easement area, also together with the permanent right and <br />easement to use additional areas for the proper construction and maintenance of drainage <br />facilities opposite approximate Stations 148+00 (left), 148+70 (right) and 149+05 (left), said <br />areas together containing 0.005 acre, more or less; together with the temporary right and <br />easement to use the additional areas shown as being required for the proper construction of cut <br />and/or fill together containing 0.190 acre, more or less. Said temporary easements will terminate <br />at such time as the construction of the aforesaid project is completed. <br /> Said deed shall provide for the following: Title to this property shall revert to the City of <br />Portsmouth, Virginia in fee simple absolute if VDOT's use of the property ever becomes <br />unnecessary by virtue of the uses of same being abandoned; that the property so transferred shall <br />be placed in a permanent conservation easement or other restrictive easement designed to protect <br />Portsmouth's potable water reservoirs; and that the property will be managed and maintained to <br />prevent sedimentation and pollution of Portsmouth's potable water reservoirs. <br /> <br /> Parcel 2: <br /> <br /> Parcel 047 - Being as shown on sheet 9B of the plans for the Southwest Suffolk Bypass, <br />State Highway Project R000-061-F01, RW201 and beginning on the north (left) side of the <br />control point line from a point opposite approximate Station 11+55, to a point opposite <br />approximate Station 30+20 and containing 5.795 acres, more or less, land. <br /> <br /> <br />
